1. Who We Are

HDN Sport Network is a trading brand operated by Hayden Clive Mitchell trading as Interlink AI, ABN 60 460 171 068 ("we", "us", "our"). We are a sole trader based in Victoria, Australia.

2. Acceptance of These Terms

By purchasing a product or subscribing to a plan, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not purchase or subscribe.

These Terms are governed by the laws of Victoria, Australia. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted or modified.

3. The Service

HDN Sport Network generates personalised AI sports highlight content (images and videos) by compositing your reference photographs into fictional sports scenarios. All generated content uses AI-created athletes, environments, and scenarios. No real player names, team names, official club logos, official arena branding, or licensed jersey designs appear in the generated output.

Content is for personal, non-commercial use and entertainment only.

4. Products and Pricing

4.1 Subscription plans

We offer two monthly subscription plans. All prices are in Australian dollars (AUD) and include GST.

Subscriptions are billed monthly via Stripe on the anniversary of your signup date. Your subscription renews automatically unless cancelled before the next billing date.

4.2 One-time packs

We also offer one-time mystery pack purchases at the prices shown on the website at the time of purchase. All prices are in Australian dollars (AUD) and include GST. One-time packs provide a single pack of AI content and do not renew.

4.3 Pricing changes

We may change subscription prices at any time. Existing subscribers will receive at least 30 days advance notice before a price change takes effect on their plan.

5. Billing and Cancellation

5.1 Automatic renewal

Subscriptions renew automatically each month. By subscribing, you authorise us to charge your payment method through Stripe on each renewal date.

5.2 How to cancel

Cancel any time from the subscriber portal by selecting "Update payment method" which opens the Stripe billing portal. From there you can cancel your subscription. Cancellation takes effect at the end of the current billing period. You will retain access and continue to receive packs until the period ends.

5.3 After cancellation

After your subscription ends, your subscriber portal access is revoked. Studio reference images are deleted within 30 days of cancellation. Generated pack content remains available for 90 days from delivery.

5.4 Failed payments

If a renewal payment fails, Stripe will retry on our behalf. If the payment cannot be collected, your subscription will be paused or cancelled and we will notify you by email.

6. Delivery

Packs are typically delivered within 24 to 48 hours of your photographs being uploaded and processed. This is an estimate, not a guarantee. Delivery times may be longer during high demand periods or if technical issues arise.

If your pack has not been delivered within 5 business days of upload, contact us at contact@hdnsport.com and we will investigate and, where possible, re-generate your pack.

Packs are delivered by email to the address you provided at checkout. Ensure your email address is correct; we are not responsible for non-delivery caused by an incorrect email address or spam filters.

7. Photographs and Acceptable Use

7.1 Ownership and consent

By uploading photographs, you confirm that:

• You are the person depicted in the photographs, or
• You hold explicit legal consent from every person depicted to use their photographs for AI generation; and
• You are at least 18 years of age, or you have obtained a parent or guardian's consent.

7.2 Prohibited uploads

The following uploads are strictly prohibited and may result in immediate account suspension:

• Photographs of a person who has not consented.
• Photographs of any person under 18, unless you are the parent or legal guardian and have explicitly consented on their behalf.
• Photographs depicting nudity, sexual content, or violence.
• Photographs of public figures where the intended use would be misleading, defamatory, or harassing.

7.3 Sport availability

Available sports are controlled by the active season configuration. We cannot guarantee any particular sport will be available when you purchase. Currently available sports are shown on the website.

8. Refunds

Each pack triggers custom AI generation that begins immediately after you upload your photographs. Because of this, we generally do not offer refunds once generation has started.

However, nothing in these Terms excludes or limits any consumer guarantee under the Australian Consumer Law. If a service we provide fails to meet a consumer guarantee (for example, if your pack is not delivered, or the generated content does not meet acceptable quality standards), you are entitled to a remedy. In those cases, contact us at contact@hdnsport.com and we will offer a re-generation, a credit, or a refund as appropriate.

9. Intellectual Property

9.1 Generated content

Generated content (images and videos) is produced using AI and does not incorporate real player names, official club logos, official team uniforms, licensed arena branding, or any other third-party IP. We grant you a non-exclusive, personal, non-commercial licence to download and share your generated content for personal use.

9.2 Your photographs

You retain all rights to the photographs you upload. You grant us a limited licence to process those photographs for the sole purpose of generating your pack. We do not acquire any other rights to your photographs.

9.3 Marketing licence

We do not use customer-submitted photographs or generated content in any marketing, advertising, or public-facing material without your explicit opt-in consent. No such opt-in mechanism currently exists. If we introduce a Wall of Fame or similar feature that displays customer content, a separate opt-in will be required and will be distinct from these Terms.

10. Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from these Terms or your use of the service is limited to the amount you paid for the specific order or subscription period that gave rise to the claim.

We are not liable for indirect, incidental, or consequential loss. This limitation does not apply to liability that cannot be excluded under the Australian Consumer Law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria.

12. Changes to These Terms

We may update these Terms at any time. The "last updated" date at the top of this page will reflect any changes. Where a change materially affects your subscription, we will notify you by email at least 14 days in advance. Continued use after that date constitutes acceptance of the updated Terms.
